The Sendup – the idea
Via The Sendup platform at www.thesendup.global, providers (companies, product developers, manufacturers) are to be brought together with potential buyers as soon as a product is in the development or early production phase. May good things rise. The providers receive thus the possibility of testing at an early stage their products at the market and of selling with interest of the buyers. Interested visitors to the platform can find out about innovative and sustainable products and - if there is sufficient interest and a minimum order quantity is reached - buy those products.
On the platform www.thesendup.global, product suggestions preselected by The Sendup are initially posted for voting by visitors to the website. Interested parties and potential buyers can find out more about the product and vote accordingly if they like it. Via The Sendup platform, potential buyers can view the product suggestions and express approval or disapproval. The relatively best rated product suggestions can be included in the order and production phase.
The relatively most selected products after the voting phase will be placed on the platform with an order option in a timely manner. Visitors to the platform can now place a binding pre-order for the product within a period specified in the product description on the platform. In case no minimum order quantity is needed, the order placement can be completed directly and the purchase contract is concluded between the provider and the purchaser. In other cases, a minimum order quantity is necessary and a purchase agreement is only concluded if a minimum order quantity specified on the platform is reached and the order is accordingly accepted or confirmed by the provider. 1.1. Via The Sendup, The DO GmbH wants to make a contribution to the environment, in line with its own guiding principle: may good things rise. Therefore, the focus is on sustainable, fair and environmentally friendly products. Such products from the areas of fashion and lifestyle are offered on The Sendup platform. Production only takes place when a certain number of orders are received, which supports a sustainable business.
1.2. The Sendup provides the platform for the meeting of suppliers and interested parties or providers and buyers.
1.3. Interested parties and buyers can print, download and/or save these terms of use.
1.4. The products offered on the website are not intended for resale. Order quantities exceeding a usual personal need are not allowed.
Article 2 Purchase process and conclusion of contract/order and declaration of acceptance
2.1 The Sendup merely establishes contact between potential buyers and sellers/providers via the platform and facilitates payment transactions. For the purchase contract itself, the terms and conditions of the respective providers apply. The Buyer should therefore read these carefully before placing a binding order.
For products with visible minimum order quantity:
The binding pre-order of the buyer via The Sendup platform is the offer to conclude a contract between the Provider and the Buyer. The offer on The Sendup platform represents here only the invitation to interested parties to submit a contract offer (request) to the Provider. The Buyer is bound to this offer until the expiry of the period provided for reaching the minimum order numbers. Only when the specified minimum order quantity of the respective provider is reached, the Provider accepts the offer of the Buyer and confirms the conclusion of the contract in text form to the respective buyer. If the minimum order quantity is not reached, the Buyer will also be informed. Any advance payments already made shall then be refunded to the Buyer.
For products without any minimum order quantity:
The pre-order via The Sendup platform leads to a product purchase and a contract between the Provider and the Buyer.
2.2. Buyers can select the products offered for order on the Platform www.thesendup.global by clicking on the corresponding images. The selected products are first placed in a shopping cart before the buyers then place their orders in such a way that they fill out the order form and accept the respective terms and conditions of the provider. Before the buyer can place his order, he must check the accuracy of the entries and make any necessary corrections. The order is placed to the Provider as soon as the Buyer selects the "pre-order now" option, whereupon the buyer then receives an e-mail confirming receipt of the order within a short time.
Article 3 Payment processing
The prices of the products offered for sale on the website include VAT plus shipping costs. Goods imported by the supplier into the EU may be subject to additional customs duties. Insofar as this should be the case, the full costs, i.e. the total price to be paid by the buyer will be displayed before he can be prompted to select the "pre-order now" button.
Article 4 Right of withdrawal
A sales contract is concluded between the supplier and the buyer. The buyer receives information on the revocation options from the provider.
Article 5 Product images

Article 9 Salvatory clause

Über die Plattform The Sendup unter www.thesendup.global sollen Anbieter (Unternehmen, Produktentwickler, Hersteller) bereits in der Entwicklungs- oder frühen Produktionsphase eines Produktes mit möglichen Käufern zusammengebracht werden. May good things rise. Die Anbieter erhalten somit die Möglichkeit, frühzeitig ihre Produkte am Markt zu testen und bei Interesse der Käufer zu vertreiben. Interessierte Besucher der Plattform können sich über innovative und nachhaltige Produkte informieren und diese – bei ausreichendem Interesse und Erreichen einer Mindestbestellmenge - kaufen.
Auf der Plattform www.thesendup.global werden von The Sendup vorausgewählte Produktvorschläge zunächst für ein Voting durch Besucher der Website eingestellt. Die Interessenten und möglichen Käufer können sich über das Produkt informieren und bei Gefallen entsprechend abstimmen. Über die Plattform The Sendup können die potentiellen Käufer die Produktvorschläge einsehen und Zustimmung oder Ablehnung äußern. Die relativ am besten bewerteten Produktvorschläge können in die Bestellungs- und Produktionsphase aufgenommen werden.
Die nach der Votingphase relativ am häufigsten ausgewählten Produkte werden zeitnah mit einer Bestellmöglichkeit auf die Plattform gestellt. Die Besucher der Plattform können das Produkt nunmehr innerhalb einer bei der Produktbeschreibung auf der Plattform angegebenen Zeitraum verbindlich bestellen. Im Falle der Bestellung eines Produktes ohne Mindestbestellmenge entsteht der Kaufvertrag zwischen Käufer und Verkäufer sofort.
Im Falle der Bestellung eines Produktes mit Mindestbestellmenge kommt ein Kaufvertrag erst zustande, sofern die auf der Plattform für das gewählte Produkt vorgegebene Mindestbestellmenge erreicht und die Bestellung sodann vom Anbieter angenommen bzw. bestätigt wird. Der Kaufvertrag wird dabei zwischen dem Anbieter und dem Besteller abgeschlossen.
Nach Ende der Vorbestellungsphase beginnt die Herstellungsphase der bestellten Produkte und Auslieferung an die Käufer innerhalb der vom Anbieter angegebenen Lieferfrist. Für Produkte mit Mindestbestellwert gilt: Wird die Mindestbestellmenge in dem vorgesehenen Zeitraum der Bestellmöglichkeit nicht erreicht, wird die Vorbestellung kostenfrei storniert.
Artikel 1 Anwendungsbereich
1.1. Über The Sendup möchte The DO GmbH einen Beitrag für die Umwelt leisten, passend zum eigenen Leitgedanken: mögen gute Dinge entstehen – may good things rise. Daher stehen nachhaltig, fair und umweltfreundlich erstellte Produkte im Mittelpunkt. Für die Plattform The Sendup werden solche Produkte aus den Bereichen Mode und Lifestyle angeboten. Eine Produktion erfolgt erst bei Eingang einer bestimmten Anzahl von Bestellungen und fördert damit ein nachhaltiges Wirtschaften.
1.2. The Sendup stellt hier die Plattform zur Begegnung von Anbietern und Interessenten bzw. Anbietern und Käufern zur Verfügung.
1.3. Interessenten und Käufer können diese Nutzungsbedingungen ausdrucken, herunterladen und/oder abspeichern.
1.4. Die auf der Website angebotenen Produkte sind nicht für den Weiterverkauf bestimmt. Bestellmengen, die einen üblichen persönlichen Bedarf übersteigen, sind nicht zulässig.
Artikel 2 Kaufvorgang und Vertragsabschluss/Bestellung und Annahmeerklärung
2.1 Die verbindliche Vorbestellung des Käufers über die Plattform The Sendup ist das Angebot zum Vertragsschluss zwischen dem Anbieter und dem Käufer. The Sendup stellt dabei lediglich den Kontakt zwischen möglichen Käufern und Anbietern über die Plattform her und erleichtert den Zahlungsverkehr. Für den Kaufvertrag selbst gelten die AGB der jeweiligen Anbieter. Diese sollte der Besteller daher vor Abgabe einer verbindlichen Bestellung sorgfältig durchlesen.
Für Produkte mit angegebener Mindestbestellmenge gilt:
Das Angebot auf der Plattform The Sendup stellt hier nur die Einladung an Interessenten dar, ein Vertragsangebot (Antrag) an den Anbieter abzugeben. An dieses Angebot ist der Besteller bis zum Ablauf der für die Erreichung der Mindestbestellzahlen vorgesehenen Frist gebunden. Erst, wenn die vorgegebene Mindestbestellmenge des jeweiligen Anbieters erreicht ist, nimmt der Anbieter das Angebot des Käufers an und bestätigt den Vertragsschluss in Textform gegenüber dem jeweiligen Käufer. Wird die Mindestbestellmenge nicht erreicht, wird der Käufer ebenfalls informiert. Eventuell bereits geleistete Vorauszahlungen werden sodann an den Käufer erstattet.
Für Produkte ohne angegebener Mindestbestellmenge gilt:
Die verbindliche Vorbestellung führt zu einem direkten Angebot indem der Anbieter das Angebot des Käufers annimmt und den Vertragsschluss in Textform gegenüber dem jeweiligen Käufer bestätigt.
2.2. Käufer können die auf der Platform www.thesendup.global zur Bestellung angebotenen Produkte auswählen, indem sie auf die entsprechenden Abbildungen klicken. Die ausgewählten Produkte werden erst in einen Einkaufswagen gelegt, bevor die Käufer dann ihre Bestellungen in der Weise tätigen, dass sie das Bestellformular ausfüllen und die jeweiligen AGB des Anbieters anerkennen. Bevor der Käufer seine Bestellung aufgeben kann, muss er die Richtigkeit der Eingaben überprüfen und etwa notwendige Berichtigungen vornehmen. Die Bestellung wird an den Anbieter aufgegeben, sobald der Käufer die „jetzt vorbestellen“ Option auswählt, woraufhin der Käufer dann innerhalb kurzer Zeit eine E-Mail erhält, in der der Empfang der Bestellung bestätigt wird.
Artikel 3 Zahlungsabwicklun
3.1. Die Preise der auf der Website zum Verkauf angebotenen Produkte verstehen sich einschließlich Umsatzsteuer zzgl. Versandkosten. Bei Waren, die vom Anbieter in die EU importiert werden, können zusätzlich Zollabgaben anfallen. Soweit dies der Fall sein sollte, werden die vollständigen Kosten, d.h. der vom Käufer zu zahlende Gesamtpreis angezeigt, bevor er dazu aufgefordert werden kann, den „Jetzt kaufen“-Knopf zu wählen.
Artikel 4 Widerrufsrecht
Ein Kaufvertrag kommt zwischen dem Anbieter und dem Käufer zustande. Informationen zu den Widerrufsmöglichkeiten erhält der Käufer vom Anbieter.
Artikel 5 Produktbilder
Der Anbieter unternimmt alle Anstrengungen, um sicherzustellen, dass die Produktabbildungen auf der Website eine authentische Wiedergabe der Produkte sind. Trotz des Einsatzes technischer Anwendungen, um Ungenauigkeiten weitgehend auszuschließen, kann es aus technischen Gründen leichte Abweichungen (z.B. in der Farbgebung) zwischen den Abbildungen auf dieser Website und den Produkten geben. Solche Abweichungen stellen keinen Mangel des Produkts dar.

Artikel 8 Streitbeilegung

Artikel 9 Salvatorische Klausel
Sollte eine der Klauseln dieser Nutzungsbedingungen unwirksam sein oder werden, bleiben die restlichen Klauseln wirksam. Statt der unwirksamen Klausel gelten insoweit die gesetzlichen Regelungen.
